General Terms and Conditions
1. Scope of Application
a) These General Terms and Conditions apply to all services provided by Praxis Psychofocus, including psychological and medical psychotherapy, counselling, diagnostic assessments, and pharmacological treatments.
b)These GTC govern the contractual relationship between Praxis Psychofocus and its clients (natural and legal persons) who make use of in-person, telephone, or digital services.
2. Services Offered
Praxis Psychofocus provides fee-based services in the areas of psychological and medical diagnostics, psychotherapy, and counselling. By making use of these services, clients agree to these General Terms and Conditions.
3. Place of Service
Unless otherwise agreed, services are provided on the premises of Praxis Psychofocus (Birmannsgasse 34, 4055 Basel).
4. Vertragsabschluss
a) Ein Vertrag kommt zustande, wenn die die Praxis Psychofocus und Klient:innen einen Termin für Diagnostik, Behandlung oder Beratung vereinbaren. Dies kann mündlich oder durch eine schriftliche Behandlungsvereinbarung geschehen.
b) Die Praxis Psychofocus kann Anfragen ohne Angabe von Gründen ablehnen, z.B. wenn die Behandlung nicht in ihr Fachgebiet fällt oder keine Kapazitäten vorhanden sind.
5. Content of the Treatment Agreement
a) Praxis Psychofocus provides its professional expertise in accordance with the highest ethical and scientific standards in order to support clients as effectively as possible in their process of growth and recovery.
b) Treatment planning is carried out jointly with clients; however, recommendations made by Praxis Psychofocus are non-binding. Clients are required to inform the practice of any relevant concerns, changes, or wishes.
c) In the event of a crisis (e.g. acute suicidality), clients undertake to contact Praxis Psychofocus or an appropriate crisis intervention service immediately.
d) Praxis Psychofocus assumes no liability for consequences arising from decisions made by clients within the context of treatment.
e) Clients are obliged to provide relevant information (e.g. symptoms, medical conditions). In the case of incomplete or inaccurate information, Praxis Psychofocus reserves the right to terminate treatment.
6. Fees
Praxis Psychofocus is entitled to remuneration for all services provided. Psychological and medical psychotherapy in Switzerland is covered by basic health insurance (excluding deductible and co-payment), provided that it serves the diagnosis, treatment, or alleviation of an illness or prevents its worsening.
Fees include in particular consultation time, preparation and follow-up time, internal case discussions for quality assurance, and administrative services related to treatment. The processing of registration and appointment scheduling is subject to fees from the time an appointment is offered.
Services provided in the absence of the client are also fully chargeable. This includes, in particular, the processing of emails (charged according to time spent, similar to telephone or other remote consultations), telephone or video consultations, the preparation of reports, certificates or statements, as well as other professional activities related to treatment.
The applicable fees are those valid at the time of the treatment or appointment agreement, or those agreed upon within a specific treatment arrangement or treatment package between Praxis Psychofocus and the client.
7. Cancellation and Non-Attendance
a) Clients receive a confirmation by SMS when scheduling or changing an appointment, as well as a reminder by SMS a few days before the appointment.
b) Agreed appointments and treatment arrangements are binding. In the event of short-notice cancellations by clients, the reserved time will be charged in full:
– for initial consultations, if cancellation occurs less than 48 hours before the appointment;
– for all other appointments, if cancellation occurs less than 24 hours before the appointment.
These deadlines refer to working days (Monday to Friday, excluding public holidays).
Example:
If an appointment is scheduled for Monday at 10:00 a.m., cancellation must be made
– in the case of an initial consultation, no later than the preceding Thursday at 10:00 a.m.;
– for all other appointments, no later than the preceding Friday at 10:00 a.m.,
in order to avoid charges.
c) Group sessions: If clients are unable to attend a scheduled group session, the agreed fee for participation remains payable. Clients are not entitled to compensation or reimbursement of the fee.
d) If Praxis Psychofocus is unable to provide a service, the fee will not be charged. However, the practice assumes no liability for any resulting costs (e.g. travel expenses).
e) Neither Praxis Psychofocus nor clients can guarantee the outcome of treatment.
f) Treatment may be discontinued at any time. Clients are responsible for payment of services already rendered. If treatment is discontinued by Praxis Psychofocus, fees for services not yet provided will not be charged.
g) If a session is shortened due to the behaviour or decision of the client (for example, due to lateness or at the client’s request), the full session fee remains payable.
8. Confidentiality
a) Praxis Psychofocus treats all information provided by clients as strictly confidential and discloses it only with the client’s explicit consent or where required by law.
b) In cases of acute risk of harm to oneself or others, Praxis Psychofocus is legally obliged to take appropriate protective measures. This may include arranging protective interventions and, in the case of minors, informing legal guardians.
c) Clients participating in group sessions undertake to maintain confidentiality regarding information shared by other participants.
9. Data Protection (DSG) and Consent to Unencrypted Email Communication
The processing of personal and health-related data is carried out in accordance with the provisions of the Swiss Federal Act on Data Protection (DSG).
If clients or other contact persons communicate with the practice via an unsecured or non-encrypted email address and transmit personal or health-related data, this shall be deemed consent to unencrypted electronic communication. The sender acknowledges that email communication without specific security measures may involve risks with regard to confidentiality and data protection.
Praxis Psychofocus is entitled to respond by email in the same manner. Responsibility for the choice of this communication method lies with the sender. For the transmission of particularly sensitive personal data, the practice recommends the use of a secure communication channel such as HIN.
10. Services Provided by Third Parties
Praxis Psychofocus assumes no liability for the arrangement or provision of services by third-party providers.
11. Disputes
Any disagreements should, where possible, be resolved amicably. Written complaints must be addressed to the respective contracting party.
12. Amendments
Praxis Psychofocus reserves the right to amend these General Terms and Conditions at any time. Clients will be informed of any changes in writing at least one month in advance.
13. Severability Clause
Should any provision of these General Terms and Conditions be deemed invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
14. Governing Law and Jurisdiction
These General Terms and Conditions are governed exclusively by Swiss law. The place of jurisdiction is Basel.
